TutorNexus (Pty) Ltd (“TutorNexus,” “we,” “our,” or “us”) provides this educational platform to support South African school learners through AI-powered tutoring that aligns with the national curriculum. By accessing or using TutorNexus, you agree to these Terms of Service (“Terms”) as a binding agreement between you and TutorNexus. If you do not agree to these Terms, please do not use the app.

1. General Information

• Purpose: TutorNexus provides AI-driven tutoring to assist South African learners with interactive, curriculum-aligned learning.
• User Base: Primarily intended for students aged 13–18.

2. User Accounts and Registration

• Registration Requirement: Users must register an account to access all features within the app.

5. Content and Intellectual Property

• Ownership: All content provided within the app is owned by TutorNexus. Certain sources are made available for user purchase, at which point the sources are for the user's personal use. Users are not to disseminate, resell, or otherwise distribute any content or sources obtained through their use of TutorNexus.
• User-Generated Content: If users submit content (e.g., answers to questions), TutorNexus reserves the right to review and manage this content to maintain quality and safety standards.
• Rights: Users agree not to reproduce, distribute, or commercialise any proprietary content without express permission from TutorNexus.

6. Privacy and Data Protection

• Data Collection: TutorNexus collects personal and educational data, including progress metrics, in compliance with the Protection of Personal Information Act (POPIA).
• Data Use and Storage: Collected data is used to personalise learning, enhance educational outcomes, and ensure safety. Data is securely stored on South African servers and is accessible only by authorised personnel.
• Parental Control over Data: Parents may request access to or deletion of their child's data if they choose to terminate the service.
• Compliance: TutorNexus strictly follows POPIA guidelines to responsibly protect and manage minors' data.

7. Payment and Subscription Details

• Subscription Fees: Access to TutorNexus requires a monthly subscription, with a free trial available for new users.
• Payment Methods: Accepted payment methods include electronic funds transfers by way of all accepted protocols.
• Refunds and Cancellations: Users may cancel at any time. Refunds are available if cancellations occur within the specified period.

8. Limitation of Liability and Disclaimers

• Disclaimer: TutorNexus strives for accuracy in its educational content but does not guarantee it. Content is provided “as is,” with no warranty of accuracy or completeness.
• Limitation: TutorNexus is not liable and is held harmless for any indirect and/or consequential damages, losses, or claims resulting from platform use or any activity related to the platform.

9. Modifications to the Terms

• Acceptance of Changes: Continued use of TutorNexus after an update implies acceptance of the revised Terms.

• Advertising: TutorNexus does not display ads within the app.
• Marketing to Parents: TutorNexus may send updates and promotional material to parents' email addresses. Parents can opt out at any time.
